Delhi HC Recalls Order on Nirbhaya’s Case, Will Hear Convict’s Claim of Being Juvenile Today Itself

The whole nation was not pleased with the decision taken by Delhi High Court, looking to the entire scenario, the Delhi High Court has recalled its order and said it will hear the matter on Thursday (19.12.2019) itself.

The plea was filed by Pawan Gupta who had claimed that he was a juvenile in 2012 when the gruesome gang rape took place. His lawyer AP Singh argued that he should hence be treated under the Juvenile Justice Act and be given a month’s time to submit fresh documents.

However, after the court adjourned the hearing till January 24, the lawyer representing Nirbhaya’s parents filed a petition objecting to the adjournment.

The plea of Nirbhaya’s parents was heard and the Delhi Court said it will hear Pawan Gupta’s matter today itself.

This situation arose a day after the Supreme Court rejected the review petition filed by Akshay Kumar Singh, another convict in the Nirbhaya gang-rape case.

Five people were convicted in the Nirbhaya case-Pawan Gupta, Vinay Kumar, Mukesh Singh, Akshay Kumar Singh, and Ram Singh. The sixth person held guilty was a juvenile and was released after serving three years in a reform home. Meanwhile, Ram Singh was found hanging in the Tihar Jail.

The Supreme Court has already rejected the review petitions of all four convicts facing death sentence and currently lodged in the Tihar Jail.
